Forest Area Swim Team

The following document is a RELEASE OF LIABILITY. Please read the entire release and indicate your agreement by checking the box below it. (If you don't agree, don't continue). The parties to this Release are ('Participant') and The Organizing Entity that is utilizing Swimtopia to organize ('Organizer'). The Participant has chosen to participate in a program and/or event defined here on Swimtopia (hereafter 'Activity'). Participant further understands that participation is voluntary.

Assumption of Risk. Participant expressly understands and agrees that participation in Activities presents risks to Participant both serious and minor, including but not limited to head or other injuries, loss of sight, broken bones, brain damage, paralysis and death. Participant is responsible for researching and evaluating the specific risks she/he may face for the Activity and is responsible for her/his actions. Participant further recognizes, understands and agrees that the Organizer assumes no responsibility for any liability, damage or injury that may be caused by Participant's negligence or willful acts committed prior to, during or after participation in the Activity, or for any liability, damage or injury caused by the intentional or negligent acts or omissions of any other participant in the Activity, or caused by any other person.

Indemnification and Hold Harmless. Participant specifically understands that she/he is personally responsible, agrees to indemnify, defend and holds harmless the Organizer, its agents, faculty, volunteers, representatives, Participants and employees from any action, claim, or demand that his/her heirs, or legal representatives, have, including reasonable attorneys' fees and/or any other associated costs, or may have for any and all personal injuries he/she may suffer or sustain, regardless of cause or fault as a result of his/her voluntary decision to participate in the Activity or related activities, on or off campus caused by any act or omission of Participant resulting from direct or indirect participation in the Activity.

Release of Claims. In consideration of being allowed to participate in the Activity, Participant, his/her heirs, executors, administrators, employers, agents, representatives, insurers, and attorneys, hereby release and discharge the Organizer, it’s employees, volunteers, Participants, agents, and representatives (hereafter 'Released Parties') from any and all claims which may arise from any cause whatsoever, including any negligent act or omission by the Released Parties. Participant further releases and discharges the Released Parties from liability for any accident, illness, injury, loss or damage to personal property, or any other consequences arising or resulting directly or indirectly from Participant's participation in the Activity. The Participant acknowledges and agrees that the Released Parties assume no responsibility for any liability, damage, or injury that may be caused by Participant's negligent or intentional acts or omissions committed prior to, during, or after participation in the Activity, or for any liability, damage, or injury caused by the intentional or negligent acts or omissions of any other participant in the Activity, or caused by any other person.

Termination of Participation. Participant understands and agrees to abide by all policies, rules, and regulations. Participant shall not engage in inappropriate conduct including the use of physical or verbal violence. Participant understands that, in its sole discretion, the Organizer may terminate Participant's participation in the Activity at any time. Reasons for termination may include, but are not limited to: inappropriate conduct or other behavior by Participant deemed detrimental to the best interests of the Activity; emergencies; or health or safety considerations. Physical Condition and Insurance. Participant attests that she/he is physically capable of participating in the Activity and has no known health restrictions that might jeopardize her/his safety or health or the safety or health of others during their participation in the Activity. Participant attests that she/he will have health insurance equal to or greater than that offered by the Participant health insurance plan at all times when participating in the Activity.

Severability. It is understood and agreed that, if any provision of this Release or the application thereof is held invalid, the invalidity shall not affect other provisions or applications of this release which can be given effect without the invalid provisions or applications. To this end, the provisions of this release are declared severable.

The language of all parts of this Release shall in all cases be construed as a whole, according to its fair meaning, and not strictly for or against any party. This Release is the only, sole, entire, and complete agreement of the parties relating in any way to the subject matter hereof. No statements, promises, or representations have been made by any party to any other, or relied upon, and no consideration has been offered or promised, other than as may be expressly provided herein. This Release supersedes any earlier written or oral understandings or agreements between the parties.

POLICIES AND WAIVERS
REFUND POLICY:
F.A.S.T. offers a one week trial period. New swimmers in particular are encouraged to try out practices and see if swim team is a good fit. If you are not completely satisfied after one week, your swim team fees will be refunded. FAST cannot handle nor guarantee a refund from FLPOA . No other refunds will be considered. This includes refunds for injuries, vacations, jobs, etc.

SWIMMER CODE OF CONDUCT:
The purpose of this conduct policy is to insure that every swimmer is provided an environment allowing them the opportunity to reach their individual goals. A swimmer’s conduct at practices and swim meets should support every other swimmer’s ability to learn and the coach’s ability to teach other swimmers.
Conduct Expected of All F.A.S.T. Swimmers:
 Remember that at practice, during swim meets and in public they are representing F.A.S.T. swimming. They should represent F.A.S.T. with excellence, team spirit, good sportsmanship, and politeness.
 F.A.S.T. swimmers are expected at all times to follow the directions of any member of the coaching staff and any person who is a chaperone. Disrespect or failure to obey instructions will not be tolerated from any athlete.
 Use appropriate language. Use of profane or abusive language or obscene gestures will not be tolerated.
 Respect each other.
 Disruption of practice by an athlete will be grounds for removal.

Basic Responsibilities for ALL F.A.S.T. Swimmers:
 Be punctual for all practices and meets.
 Attend all meets unless special arrangements are made with coach.
 Be an active participant in all team practices and meets.
 Put forth his/her best effort at practices.
 Follow the coach’s directions.
 Be polite and respectful to others.
 Follow the spirit of the rules as well as the specific rules.

I hereby give Forest Area Swim Team (F.A.S.T.), its assigns, licensees and legal representatives the irrevocable right to use my image and the above registered swimmer(s) name/photograph/image/audio recording/video recording/ and likeness (“Images”) in all forms and manner including but not limited to publication on Internet Web Sites, broadcasts and any other publications as released to or by F.A.S.T. I understand that F.A.S.T. cannot control unauthorized use of Images by persons not associated with F.A.S.T. once Images have been published. I hereby forever waive any right to inspect or approve any publication of Images by F.A.S.T. I have carefully reviewed and understand the above provisions and agree to be bound by them. I voluntarily and irrevocably give my consent and agree to this Release and Waiver.

It is my intent as a participant or player competing in Forest Area Swim Team sanctioned activities, while participating during activities including any pre-game or post-game activities that I am agreeable to the following:

I acknowledge that I am aware that there are risks to me of exposure to directly or indirectly arising out of, contributed to, by, or resulting from:

An outbreak of any and all communicable disease, including but not limited to, the virus “severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2)”, which is responsible for Coronavirus Disease (COVID-19) and/or any mutation or variation thereof;

In consideration of having the opportunity to participate as either a team member or competitor at location, and in acknowledging that I am aware of and willing to assume the risks associated with this activity, I hereby voluntarily agree to waive, hold harmless and indemnify Forest Area Swim Team and its trustees, agents, volunteers and employees from any and all claims, demands, damages and causes of action of any nature whatsoever arising out of ordinary negligence which I, my heirs, my assigns or successors may have against them for, on account of, or by reason of my participation in the above activities.
